NOTICE OF INTENT TO SOLE SOURCE ***THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS, AND NO SOLICITATION DOCUMENT EXISTS FOR THE REQUIREMENT*** INTERESTED VENDORS MUST INCLUDE THE FOLLOWING IN THEIR SUBJECT LINE REFERENCE: �HT940626NOI4547� OR RISK THE GOVERNMENT NOT RECEIVING THEIR RESPONSE DUE TO EMAIL SECURITY FEATURES. IT IS SOLELY UP TO THE VENDOR TO ENSURE THEIR RESPONSE WAS RECEIVED BY THE CLOSING DATE AND TIME. The Defense Health Agency (DHA) intends to negotiate a sole source contract under the authority of FAR � 12.102(a) and 41 U.S.C. 3304 with Philips North America LLC (Philips), 222 Jacobs St. East Cambridge, MA, 02141-2296, for the provision of patient monitoring system maintenance and original equipment manufacturer (OEM) parts for currently installed Philips equipment for the Naval Medical Center Portsmouth, VA (NMCP). The period of performance is for a period of 60 months broken out in one12-month base period, with four 12-month option periods. The Contractor shall provide OEM maintenance support and coverage for all equipment listed in Exhibits 2 and 3. The Equipment listed in Exhibits 2 and 3 will change based on equipment becoming End of Service Life (EOSL) and equipment coming off warranty. Support of the devices stated in Exhibit 2 shall include the supply of all parts and over the phone maintenance support. Support for the devices stated in Exhibit 3 shall include telephone support, on-site field support, and system hardware and software updates, as mandated by the OEM, in accordance with the PWS. All parts, labor, and travel shall be included. The Contractor shall maintain all equipment listed in the PWS. The Contractor shall maintain the systems within the OEM specifications, in accordance with all U.S., State, and Local laws and regulations, Defense Health Agency, and U.S. Navy regulations, instructions, and Joint Commission requirements. The Joint Commission�s requirements are specified in its Comprehensive Accreditation Manual for Hospitals (CAMH), readily found on https://www.jointcommission.org/. U.S. Navy regulations and instructions will be made available upon request. The Contractor must maintain any networkable systems such that they meet Navy and Defense Health Agency (DHA) Cybersecurity requirements. When product recalls or updates are necessary to maintain the contractual equipment inventory within the OEM�s specifications, the Contractor shall obtain and install all associated software patches/updates/upgrades. The aggregate amount of equipment covered under the contract shall fluctuate over time, as hardware and software eclipse useful life and as new equipment comes off warranty. However, the aggregate requirement and level of effort will remain relatively constant over the life of the contract. Any changes to the equipment list will be executed through an official contract modification. The Contractor shall be an OEM authorized maintenance contractor for the proposed equipment/system, such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. Sources interested in responding to this notice are required to submit a capability statement that includes product/technical data, in sufficient detail and with convincing evidence that clearly demonstrates the capability to provide the required services. All capability statements received by the due date of this notice will be considered by the Government. A request for documentation or additional information, or submissions that only ask questions will not be considered as an affirmative response. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed with a sole source contract. Capability statements are due by the announcement closing date and time.
